4 months in jail or 4 years on probation, what would you chose? June 30, 2009

I had a long morning of waiting today, but actually resolved one case.  Only thing to do now is to convince him that he should flatten out his time in jail instead of taking a 4 year probation.  I don't think he realizes that probation is not easy and will cost him time and money, that if he messes up in any way, he's going to jail again.  Unfortunately, it's not my place to give him that advice.  I'm giving him a week to think about it.

3 for 3 today: no clients showed up for court today June 12, 2009

Of course, what makes this funny and not pathetic is that all 3 were in custody. Just for various reasons, no one was brought up for court. One was even a TDOC transfer. Can’t file the orders to keep him here for me to talk to him and can’t file the orders to send him back. Catch 22, which could have meant they kept him here till his next court date. Luckily, the lack of authority to keep him here trumps the absence of an order to send him back, therefore they sent him back. Sent via BlackBerry by AT&T

 

Crime or Contract: if you return a rental late, are you guilty of theft or conversion? June 11, 2009

I have client who is accused of theft of property for not returning his tux on time. My client says he returned the tux very late, but that he did return it. The state says he hasn’t returned it. The discovery materials I have received have not been updated in close to a year. Basically, the rental receipt shows a deposit and rental paid, and shows that. $25 late fee shall be assessed per day late. So to me, the rental contract terms would govern this transaction. Further, its been advised to me that the crime would depend on the mental state and time of the transaction. If my client had intended to steal the tux or fraudulently signed this contract, he’s guilty of fraud, if not theft. But why pay money to steal a used suit? Oh, btw, I think all the groomsmen returned the tuxes late, and are now being charged with theft. What do you think?
